Defective Tires
Rollover accidents are most frequently caused by tire defects, the results of which include car tire explosions and tread separations. Tire tread separation generally occurs when the adhesives fail that hold the belt and tread together, in other words, the metal and rubber separate. Part of the problem is the design and placement of the belts and treads. Poor adhesion can be caused by old or expired adhesives, improper curing, dirty manufacturing plants and foreign objects in the tires.
Lower tire pressures, which have been recommended by car manufacturers to increase stability and soften the ride, actually increase the probability of a tire overheating. An overheated tire is more at risk for tread separation and tire explosion. Low tire pressure is even more dangerous when a vehicle is driven at high speed and in hot weather.
In civil actions for damages, legal responsibility for injuries caused by tire defects is usually determined under the law of product liability. A product liability case arises when someone uses a dangerous product that injures them – the tire in this case.
